Gandiv Live is dedicated to respecting the intellectual property rights of others and expects all users and contributors to do the same. We adhere to the provisions of the Indian Copyright Act, 1957, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

This page outlines the procedure for submitting copyright infringement claims (Takedown Notices) regarding content hosted on https://livegandiv.in/.


1. Reporting Copyright Infringement (Takedown Notice)

If you are a copyright owner or an agent authorized to act on behalf of the owner and believe that any content on our platform infringes upon your copyright, you must submit a formal written complaint (Takedown Notice) to our designated Copyright Agent.

Requirements for a Valid Takedown Notice

To ensure compliance with Rule 75 of the Copyright Rules, 2013, your notice must be comprehensive and include the following:

  1. Identification of the Copyrighted Work: A description of the copyrighted work that has been infringed. If multiple works are involved, a representative list is required.
  2. Proof of Ownership: Details establishing that the complainant is the owner or exclusive licensee of the copyright in the work.
  3. Location of Infringement: Identification of the allegedly infringing content, including the specific URL(s) on our website where the material is located.
  4. Statement of Good Faith: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law (including Fair Use/Fair Dealing exceptions).
  5. Accuracy and Authority Statement: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  6. Contact Information: Your full legal name, physical address, telephone number, and email address.
  7. Physical or Electronic Signature: A physical or electronic signature of the person authorized to act on behalf of the copyright owner.

2. Our Takedown Procedure

Upon receipt of a valid written Takedown Notice, Gandiv Live will take the following steps:

  1. Acknowledgement: We will acknowledge receipt of the complaint.
  2. Removal: We will expeditiously remove or disable access to the allegedly infringing material within 36 hours, as required under the IT Rules, 2021, and the Copyright Act.
  3. Notification: We will promptly notify the user/contributor who posted the content that the material has been removed.

Legal Immunity: By promptly acting upon a valid Takedown Notice, Gandiv Live seeks to maintain its statutory immunity (Safe Harbor) under Section 79 of the IT Act.


3. Counter-Notification Procedure

The affected user/contributor has the right to file a Counter-Notification if they believe the content was removed due to mistake or misidentification (e.g., they believe their use was covered under Fair Use).

A valid Counter-Notification must include:

  1. Identification of the material that has been removed and its URL location before removal.
  2. A statement, under penalty of perjury, that the material was removed by mistake or misidentification.
  3. The user’s contact information (Name, Address, Phone, Email).
  4. A statement that the user consents to the jurisdiction of the appropriate court in Ranchi, Jharkhand.

4. Policy on Repeat Infringers

Gandiv Live maintains a strict policy of terminating the access and accounts of users who are determined to be repeat infringers of copyrighted content.
